1. What Friendly Encounter Is

Friendly Encounter is a location-based social app that helps people who are physically nearby and share interests discover one another, signal interest, and start a conversation. The App is a tool for facilitating connections. We do not arrange, supervise, endorse, or take part in any meeting, interaction, or relationship between users.

2. Eligibility

You must be at least 18 years old to use Friendly Encounter. By using the App, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. We do not knowingly permit anyone under 18 to use the App, and we may remove any account we believe belongs to a minor.

3. Meeting Other People — Assumption of Risk

Friendly Encounter connects you with people you do not know. Meeting strangers, whether in person or online, carries inherent risks. You use the App and meet other users entirely at your own risk.

We do not conduct criminal background checks on users. While the App uses a live selfie to help confirm a person's present appearance, this is not a guarantee of any user's identity, character, intentions, or safety. A photo match confirms likeness only — it does not verify who someone truly is or whether they are trustworthy.

You are solely responsible for your own safety and for your interactions with other users. We strongly encourage you to:

• Meet in public places, especially the first time.
• Tell a friend or family member where you are going and who you are meeting.
• Trust your instincts and leave any situation that feels unsafe.
• Never share financial information or send money to anyone you meet through the App.
• Report any user who behaves inappropriately or makes you feel unsafe.

4. User Conduct

You agree that you will not use Friendly Encounter to:

• Harass, threaten, stalk, abuse, defraud, or harm any other person.
• Impersonate anyone, or misrepresent your identity, age, or affiliation.
• Post or share content that is unlawful, hateful, sexually explicit, violent, or otherwise objectionable.
• Solicit money, promote commercial activity, or send spam.
• Collect or store other users' personal information without their consent.
• Use the App for any illegal purpose or in violation of any applicable law.

We reserve the right to suspend or permanently remove any account, at our sole discretion and without notice, for conduct we believe violates these Terms or harms other users.

5. Content and Reporting

You are responsible for the content you share, including your profile, photos, and messages. The App provides tools to report and block other users. We review reports and may take action, but we are not obligated to monitor all content and cannot guarantee that objectionable content or conduct will be prevented.

There is zero tolerance for objectionable content or abusive behavior. Reports are reviewed, and accounts found in violation may be removed.

6. No Warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, error-free, or that it will meet your expectations. We make no warranty regarding the conduct, identity, or safety of any user, or regarding the outcome of any interaction or meeting facilitated by the App.

7. Limitation of Liability

To the fullest extent permitted by law, David Austin and Friendly Encounter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss, injury, or harm — including physical, emotional, or financial harm — arising out of or related to your use of the App or your interactions with other users.

This includes, without limitation, any harm resulting from the conduct of other users, whether online or in person. You acknowledge that we have no control over and are not responsible for the actions of any user. To the extent any liability cannot be excluded, our total liability to you for any claim arising from these Terms or the App shall not exceed one hundred US dollars ($100).

8. Indemnification

You agree to indemnify and hold harmless David Austin and Friendly Encounter from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your interactions with other users.

9. Account Termination

You may delete your account at any time from within the App, which removes your profile and associated data as described in our Privacy Policy. We may suspend or terminate your access at any time, with or without cause.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.
